Terms of Service
These Terms of Service ("Terms") govern your access to and use of trueworngear.com (the "Site"), operated by TrueWornGear ("TrueWornGear", "we", "us"), a business based in South Carolina, United States. By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
1. About the products
TrueWornGear sells gear sourced from college athletes, including team-issued gear, training and practice gear, game-worn pieces, and items from an athlete’s own collection. Not every item is game-worn, and we do not claim any item is game-worn unless the listing says so. Every listing is a single physical item, sold once. Item descriptions, photos, condition notes, and provenance information are provided in good faith based on our best information at the time of listing. Minor variations in color, wear, and presentation are inherent to used apparel and are not defects.
2. Eligibility
You must be at least 18 years old, or have your parent or guardian's permission, to make a purchase. By placing an order you represent that you have the legal capacity to enter into these Terms.
3. Pricing and payment
- All prices are in U.S. dollars (USD).
- Where we are required to collect sales tax, it will be shown at checkout before you pay.
- Payment is processed by Stripe. Your transaction is subject to Stripe's terms in addition to ours.
- An order is not accepted until we send a confirmation email. We reserve the right to refuse or cancel any order at our discretion, including pricing errors, fraud signals, or stock issues. If we cancel an order you have paid for, we will issue a full refund.
4. Shipping
We ship nationwide within the United States via standard carriers (USPS, UPS, FedEx), and to Canada and Mexico. Shipping costs are displayed in your cart before you pay; Free shipping is not automatic; it applies only when a valid promotional code is used, and such codes apply to US orders unless stated otherwise. International orders: prices are in USD and exclude any customs duties, import taxes (such as GST/HST) and carrier brokerage fees, which are set by the destination country and collected from you by the carrier on delivery. We are not able to calculate or refund those charges, and a parcel refused at the border is treated as a return under the section below. We declare the actual purchase price on all customs documentation. Title and risk of loss pass to you when the carrier accepts the shipment. We are not responsible for carrier delays or losses once the package leaves our possession; for damaged or lost shipments, please contact us at [email protected] and we will assist with the carrier claim where possible.
5. Returns and refunds
Because every piece is a single item we cannot replace, all sales are final except in the following cases:
- The item delivered materially differs from its listing (e.g. wrong size, wrong athlete, undisclosed damage).
- The item arrives damaged due to shipping.
- We made a factual error in the provenance disclosure.
How to request a return. Email [email protected] within 7 days of delivery with your order number, photos of the item as received, and a description of the problem. We will reply within 2 business days.
Returns must be authorised before they are sent. If your request is approved we will issue you a Return Authorisation (RA) number and the address to send it to. Please do not ship anything back before you have that number. Unauthorised parcels cannot be matched to an order and may be refused or returned to sender.
- The item must be postmarked back to us within 7 days of the RA being issued.
- It must arrive in the same condition it was sent, unworn since delivery, with any tags, certificates of authenticity and original packaging included.
- Send it with tracking and give us the tracking number. Until it reaches us the parcel is your responsibility, and a return we never receive cannot be refunded.
- Because every return we accept is for our error, we cover return shipping: we will send you a prepaid label or reimburse the postage against a receipt.
When you get your money back. We inspect the item on arrival and issue your refund to the original payment method within 5 business days of receiving it. Refunds are for the item price plus the shipping you originally paid. Your bank typically takes a further 5–10 business days to post it.
If the returned item does not match the problem described, or arrives worn, altered or damaged beyond how it was sent, we will contact you before doing anything and may refund in part or return the item to you. Customs duties and import taxes paid on international orders are set and collected by your own country and are not refundable by us.
6. Accounts
If you create an account (e.g. by signing in with Google), you are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
7. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the Site, the underlying servers, or other users' accounts.
- Scrape, harvest, or replicate Site content without our prior written permission.
- Resell items purchased here under false claims about their provenance or origin.
- Interfere with the Site's operation (e.g. via automated bots, denial-of-service attempts, or malware).
8. Intellectual property
The Site, its design, text, photographs, logos, and brand name are owned by TrueWornGear or our licensors and are protected by copyright, trademark, and other laws. You may not use them without permission. School names, mascots, jersey numbers, and athlete names referenced in listings are the property of their respective owners and are used here for identification and provenance purposes only.
9. Disclaimers
THE SITE AND ALL ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Items sold here are used. Cosmetic wear, alterations, and irregularities consistent with athletic use are expected and not grounds for return except as set forth in Section 5.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUEWORNGEAR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ITEM AT ISSUE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Indemnification
You agree to indemnify and hold harmless TrueWornGear and its owners, employees, and partners from any claim or demand arising out of your breach of these Terms or your misuse of the Site.
12. Governing law and disputes
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in South Carolina, and you consent to the personal jurisdiction of those courts.
13. Changes
We may modify these Terms at any time. The revised Terms become effective when posted. Your continued use of the Site after changes constitutes acceptance.
14. Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
